DALLAS, Oct. 26, 2026 /PRNewswire/ -- The mother of a 3-year-old girl is suing The Learning Experience on Frankford Road in Dallas, alleging that one of the daycare center's caregivers grabbed her daughter and shoved her toward a sink. The suit states the incident took place while the mother watched the classroom surveillance feed on monitors in the daycare director's office. The Learning Experience tells families it is built on a "foundation of trust, education, and family-focused care," but Franchester Wilson's lawsuit alleges the center failed to properly hire, train, and supervise its staff, and an employee neglected their duties as a caregiver.
According to the lawsuit, Wilson stopped by the center unannounced to pick up an item around lunchtime on Sept. 3, 2025. Her daughter had recently started saying that her caregiver was angry and had hit her, per the complaint. While she was at The Learning Experience, Wilson asked to watch her daughter's classroom on the live feed displayed in the director's office, which the center advertises to parents as a safety feature.
The lawsuit states that Wilson observed her daughter get up from the lunch table, and she then witnessed a caregiver grab the toddler and push her toward the sink, causing the toddler to stumble. Wilson pointed at the screen and asked the director and another staff member in the office whether they had just seen the incident involving her daughter. As they watched, the lawsuit alleges, the caregiver grabbed a second child in the toddler class and threw that child to the ground.
The daycare director then left the office and rushed to the toddler classroom, per the complaint. By the time Wilson got there, the director had sent the caregiver away. Wilson removed her daughter from the center and reported what she saw to the authorities.
"My daughter told me her teacher was mad at her and had hit her, so I went in that day to see for myself," says Wilson. "I didn't have to wait long. The horrific treatment of my 3-year-old daughter at The Learning Experience feels like the ultimate betrayal."
State investigators cited The Learning Experience for breaking two childcare laws. According to the complaint, the state found the caregiver used a prohibited punishment by grabbing children aggressively and failed to show competency, good judgment, and self-control.
"Those surveillance cameras were streaming into the director's office all day, and a mother saw what was happening to her child within a few minutes of looking at the screen," says The Button Law Firm daycare injury attorney Russell Button, who represents Wilson and her daughter. "The Learning Experience points to that surveillance system as a reason parents can entrust it with their children. What are cameras for if no one is watching?"
The case is Franchester Wilson, Individually and as parent and next friend of N.B., a minor child, vs. Peace Nest Childcare, LLC d/b/a The Learning Experience Dallas; and the named caregiver, Cause No. 002-08839-2026 in Collin County, Texas. A copy of the complaint can be accessed here.
